These Terms & Conditions (“Terms”) govern your access to and use of the Achievr Guru website, early‑access programme, and full‑launch service.
1. Acceptance of Terms
By accessing Achievr Guru in any phase, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. Definitions
- "Service" – the website, mobile apps, APIs and software.
- "Early‑Access" – invitation‑only beta before launch.
- "Content" – text, graphics, goals or other data you post.
- "Subscription" – a paid plan after Public Launch.
3. Eligibility & Account Registration
You must be at least 16 years old and capable of forming a binding contract. You agree to provide accurate information and to keep credentials confidential.
4. Service Phases

We reserve the right to modify or discontinue any phase with reasonable notice.
5. Subscriptions & Payments
- Plans renew automatically until cancelled.
- You may cancel any time; access continues until the end of the billing cycle.
- Prices exclude applicable taxes; VAT/GST will be added where required.
- We use WayforPay for payments; your card data never touches our servers.
Refunds: 14‑day cooling‑off period for EU consumers, otherwise refunds are discretionary unless local law requires.
6. User Content & Licence
You retain ownership of your Content. By uploading, you grant Achievr Guru a worldwide, non‑exclusive, royalty‑free licence to host, display, and process the Content solely to operate the Service. You are responsible for ensuring that Content and measurement units you enter are lawful and do not infringe third‑party rights.
7. Acceptable Use
You agree NOT to:
- 1. Use the Service for unlawful, harmful, or misleading purposes.
- 2. Upload malware or attempt to reverse‑engineer our software.
- 3. Exploit early‑access vulnerabilities outside authorised bug‑bounty channels.
- 4. Share the Service with minors under 16.
- 5. Resell or white‑label the platform without written consent.
8. Intellectual Property
All Service components (code, design, trademarks) are and remain the property of Achievr Guru or its licensors. Nothing in these Terms transfers any IP rights to you beyond the limited licence above.
9. Beta Disclaimer (Phase 2)
Early‑Access features are pre‑release and may contain errors. They are provided “as‑is” without warranties of any kind. Data loss is possible; keep backups of critical information.
10. Health & Financial Disclaimer
Achievr Guru provides informational and organisational tools only. We are not a medical, psychological, legal, or financial advisor. Always consult qualified professionals before making health or financial decisions.
11. Warranties & Liability
The Service is provided “as‑is” and “as available”.
To the fullest extent permitted by law:
- No Indirect Damages — Achievr Guru shall not be liable for lost profits, data, or goodwill.
- Liability Cap — Our aggregate liability is limited to the greater of (a) EUR 100 or (b) the amount you paid us in the preceding 12 months.
- Consumer rights under mandatory law (e.g., EU consumer legislation) remain unaffected.
12. Indemnity
You will indemnify and hold Achievr Guru harmless against claims arising from your breach of these Terms or misuse of the Service.
13. Modifications to Terms
We may update these Terms. We will give at least 14 days’ notice (via email and in‑app banner) before substantive changes take effect. Continued use after the effective date constitutes acceptance.
14. Suspension & Termination
We may suspend or terminate your account for material breach or if required by law. On termination, your licence ends and you must stop using the Service. Subscription fees already paid are non‑refundable except as provided in Section 5.
15. Governing Law & Dispute Resolution
- Governing law: Laws of Ukraine, without regard to conflict-of-law principles.
- European consumers may rely on mandatory local consumer protections.
- Arbitration: If you are not a consumer, any dispute will be finally resolved under the Arbitration Rules of the International Commercial Arbitration Court at the Ukrainian Chamber of Commerce and Industry (ICAC) in Kyiv. Consumers may use the EU ODR platform.
16. Entire Agreement & Severability
These Terms constitute the entire agreement between you and Achievr Guru. If any provision is held invalid, the remainder remains in full force.
